对依照本法第二十三条第二款规定可能执行行政拘留的未成年人，公安机关应当告知未成年人和其监护人有权要求举行听证；未成年人和其监护人要求听证的，公安机关应当及时依法举行听证。对未成年人案件的听证不公开举行。
